Terms and Conditions

These Terms and Conditions apply to all quotations, invoices, manufacturing, supply, delivery, installation, renovation, repair, and project work carried out by 360 Home Enhancers.

By accepting a quotation, making payment, paying a deposit, allowing work to commence, or continuing with the project, the client acknowledges that they have read, understood, and accepted these Terms and Conditions.


1. Quotations, Invoices and Scope of Work

All quotations are based only on the items, measurements, materials, finishes, labour, and services specifically listed in the quotation.

Any item, accessory, appliance, shelf accessory, fitting, hardware, material, labour, transport, travelling, accommodation, or additional work not listed as a line item on the quotation or invoice will be treated as an additional cost and may be added to the final invoice.

Verbal or written instructions from the client requesting additional work, changes, upgrades, replacements, or materials after the quotation or invoice has been accepted may result in additional charges.

360 Home Enhancers reserves the right to amend or revise a quotation before acceptance, and where necessary revise or issue an updated invoice after acceptance, if there are changes in material costs, availability, client requirements, site conditions, transport costs, or any other circumstances that affect the original quotation or invoice.


2. Payment Terms

Unless otherwise agreed in writing, the standard payment structure is as follows:

60% deposit payable upon acceptance of the quotation.
30% progress payment payable upon commencement of the project.
10% final payment payable the day before project completion, final installation, or project handover.

Work will not proceed on the final day, and no project handover will take place, unless the final payment has been received and cleared in full.

All approved variations, additional costs, travelling costs, accommodation costs, labour charges, material charges, and any other agreed costs must be settled before completion and handover.

Any discounts offered are discretionary and are not guaranteed. Discounts may be revoked at any time before the final invoice is issued, at the sole discretion of 360 Home Enhancers. Discounts do not create a right or entitlement and are granted on a case-by-case basis.


2.1 Final Invoice and Yoco Payment References

The official final invoice for any project will be issued by 360 Home Enhancers from info@360home.co.za before project completion, final installation, and/or project handover.

Any payment link, payment request, receipt, or invoice generated through Yoco or any other third-party payment platform is used for payment processing and reference purposes only. Such Yoco invoices or payment references do not replace, amend, or override the official final invoice issued by 360 Home Enhancers.

The amount reflected on the official final invoice sent from info@360home.co.za shall be regarded as the final amount due, including the project balance, approved variations, additional costs, travelling costs, material costs, labour costs, and any other charges applicable to the project.

The client remains responsible for settling the full amount reflected on the official final invoice before completion, final installation, and/or project handover. Payment made through Yoco or any other payment platform will be allocated against the official final invoice balance.


3. Ownership of Materials and Retention of Goods

All materials, fittings, manufactured items, doors, panels, cabinets, vanities, cupboards, accessories, hardware, and any other goods supplied, manufactured, or installed by 360 Home Enhancers remain the property of 360 Home Enhancers until the full outstanding balance has been paid and cleared.

Ownership will only pass to the client once full and final payment has been received.

Where the client fails to make final payment in full, the project will not be regarded as completed or handed over, even if partial installation has taken place.

360 Home Enhancers reserves the right to pause work, withhold completion, withhold handover, retain supplied goods, or remove supplied goods where payment has not been made in full.

Should the client fail to settle the outstanding balance within 14 business days after written notice, 360 Home Enhancers reserves the right to recover its losses by reselling, reusing, or disposing of retained goods or materials.

Any proceeds recovered from the sale or reuse of such goods may be credited against the outstanding balance. If the proceeds do not cover the full outstanding amount, the client will remain liable for the shortfall, including storage, transport, collection, administrative, legal, and recovery costs.

Where goods, materials, doors, panels, cabinets, or manufactured items are retained due to non-payment, 360 Home Enhancers reserves the right to charge reasonable storage fees from the date the client is notified in writing until the outstanding balance is settled or the goods are disposed of, resold, or reused.


4. Project Completion and Handover

A project will only be deemed complete and handed over once:

full payment has been received and cleared;
all approved additional costs have been settled;
the final installation or agreed scope of work has been completed; and
360 Home Enhancers has confirmed the project handover.

No limited warranty or workmanship cover will commence until the project has been paid for in full and officially handed over.

If the client delays payment, refuses access, delays decisions, changes the scope, or causes any delay that prevents completion, 360 Home Enhancers will not be held liable for project delays or extended timelines.


5. Limited Workmanship Warranty

All products manufactured and installed by 360 Home Enhancers carry a limited 6-month workmanship warranty, starting from the date of official project handover.

This limited warranty covers defects directly related to workmanship and craftsmanship under normal usage.

The warranty does not cover damage caused by:

misuse; negligence; water damage not caused by our workmanship; structural movement; normal wear and tear; improper cleaning; unauthorised modifications; third-party repairs or alterations; improper handling; abuse of the product; failure to maintain the product; or damage caused after delivery, installation, or handover.

The client must report any defects covered by the warranty within the 6-month warranty period for assessment. 360 Home Enhancers will evaluate the reported defect and, where the defect falls within the limited workmanship warranty, may repair or replace the affected item at its discretion.

This limited workmanship warranty does not replace or limit any rights the client may have under applicable South African consumer protection laws.

6. Third-Party Installation and Liability

Where installation is performed by a third party, 360 Home Enhancers will not be held liable for any damage, defect, poor workmanship, incorrect installation, misalignment, breakage, or issue arising from the third-party installation.

Upon request, 360 Home Enhancers may provide contact details of independent third-party installers for the client’s convenience. These installers operate independently and are not employees, agents, or representatives of 360 Home Enhancers.

Any agreement, payment, instruction, or dispute between the client and a third-party installer is strictly between those parties. 360 Home Enhancers accepts no responsibility for third-party workmanship, damages, delays, or defects.


7. Existing Damages, Site Conditions and Client Responsibility

Before work commences, the client must disclose any known issues, damages, leaks, damp, electrical problems, plumbing problems, structural defects, uneven walls, weak surfaces, or any other site conditions that may affect the work.

360 Home Enhancers will not be held liable for pre-existing damages, hidden defects, weak structures, poor previous workmanship, water leaks, electrical faults, plumbing faults, or structural issues that were not caused by 360 Home Enhancers.

Where additional work is required due to hidden or existing issues discovered during the project, such work will be quoted or added as an additional cost.

The client is responsible for ensuring that the work area is accessible, safe, and ready for the agreed work to commence.


8. Measurements, Fitment and Access

The client is responsible for confirming that supplied measurements, spaces, access points, lifts, staircases, doorways, walls, and rooms are suitable for the products or work requested.

360 Home Enhancers will not be held responsible where an item does not fit due to incorrect measurements supplied by the client, changes to the site, restricted access, or failure by the client to disclose relevant information.

Where modifications, additional labour, return trips, special handling, or alternative installation methods are required, additional charges may apply.


9. Variations and Additional Costs

Any changes requested after acceptance of the quotation may result in additional charges.

This includes, but is not limited to:

changes in design;
changes in colour or finish;
changes in material;
additional shelves, accessories, fittings, or hardware;
additional plumbing work;
additional electrical work;
additional tiling, painting, ceiling, or building work;
glass, mirrors, lighting, countertops, basins, taps, or appliances not included in the quotation;
extra travelling, accommodation, or meal costs; and
any work required due to unforeseen site conditions.

Additional costs may be added to the final invoice and must be paid before completion and handover.


10. Travelling, Delivery, Accommodation and External Cost Increases

Travelling, delivery, accommodation, toll fees, and meal costs may be charged where applicable.

Where only delivery is required and no accommodation is necessary, travelling may be charged at the agreed delivery or travel rate.

Where accommodation is required due to the distance or duration of the project, travelling may be charged at a higher return-trip rate, together with accommodation and meal costs where applicable.

Fuel price increases, toll fee increases, transport increases, accommodation increases, supplier increases, material increases, courier increases, and other cost increases beyond the control of 360 Home Enhancers may be added to the final invoice without requiring further client approval, provided they are reasonable, unavoidable, and directly related to the continuation, delivery, or completion of the project.

Where such increases occur, 360 Home Enhancers reserves the right to reasonably adjust the final invoice to reflect the additional costs incurred. These costs will be treated as necessary project-related expenses and must be settled before completion and handover.

360 Home Enhancers will, where practical, notify the client of such increases. However, where the increase is unavoidable and necessary for the continuation, delivery, or completion of the project, the client remains liable for the additional cost.


11. Delays, Paused Work and Non-Payment

360 Home Enhancers reserves the right to pause work where:

payments are overdue;
the client has not paid the required deposit, progress payment, or final payment;
approved additional costs have not been settled;
materials are delayed or unavailable;
the client delays decisions or access;
the site is not ready;
there are safety concerns; or
unforeseen site conditions prevent progress.

Where work is paused due to non-payment or client-caused delays, 360 Home Enhancers will not be liable for delayed completion.

Additional call-out fees, storage costs, transport costs, labour costs, or remobilisation fees may apply before work resumes.


12. Warranty and Settlement Clause

Where there is a dispute regarding workmanship, service delivery, project completion, or the final balance, and both parties agree to a reduced, discounted, or negotiated settlement amount, the client accepts the work in its current condition unless otherwise agreed in writing.

Where the client accepts a discounted or reduced settlement amount in respect of the final balance, the standard workmanship guarantee may be deemed null and void, unless 360 Home Enhancers confirms otherwise in writing.

By accepting the reduced settlement, the client acknowledges that the matter has been settled and waives any further claims relating to defects, corrections, discounts, refunds, or warranty coverage, except where such claims cannot legally be excluded under South African law.


13. Defects and Repairs

Any defect or issue must be reported to 360 Home Enhancers in writing, together with clear photographs or videos where applicable.

360 Home Enhancers must be given a reasonable opportunity to inspect, assess, and where appropriate, repair any alleged defect.

The client may not appoint another contractor to repair, alter, remove, or modify the work before giving 360 Home Enhancers a reasonable opportunity to inspect and address the issue.

If another contractor modifies, removes, repairs, or damages the work before assessment by 360 Home Enhancers, the workmanship guarantee may be void.


In the event of any amount remaining unpaid after the due date, 360 Home Enhancers shall be entitled, without prejudice to any other rights it may have, to recover from the client all amounts owing, together with interest, collection fees, and all legal costs incurred in recovering such amounts.

Such legal costs may include, but are not limited to, attorney-and-client legal fees, tracing fees, collection commission, storage fees, transport fees, administrative fees, and any other costs reasonably incurred in enforcing payment or compliance with these Terms and Conditions.

The client consents to the jurisdiction of the Magistrate’s Court, notwithstanding that the amount claimed may exceed its monetary jurisdiction, where legally permissible.


15. Consumer Protection and Applicable Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Nothing in these Terms and Conditions is intended to unlawfully limit or remove any rights the client may have under the Consumer Protection Act or any other applicable South African law.

Any disputes, claims, or complaints will be handled in accordance with the applicable laws of South Africa.


16. Right to Refuse, Pause or Withdraw Service

360 Home Enhancers reserves the right to refuse, pause, withdraw, or discontinue any service, project, delivery, installation, or handover where there is non-payment, late payment, breach of these Terms and Conditions, unsafe site conditions, abusive conduct, unreasonable demands, lack of access to the site, or any conduct that prevents the successful completion of the project.

Where service is refused, paused, or withdrawn due to the client’s conduct, non-payment, or breach of agreement, the client shall remain liable for all work completed, materials supplied, costs incurred, and any additional recovery, storage, transport, legal, or administrative costs.

360 Home Enhancers further reserves the right to decline future work or services to any client where there has been non-payment, repeated disputes, abuse, dishonesty, or conduct that damages the working relationship.


17. Acceptance of Terms

By accepting a quotation, paying a deposit, making any payment, approving work, allowing work to commence, or receiving any goods or services from 360 Home Enhancers, the client confirms that they have read, understood, and accepted these Terms and Conditions.

Payment made to 360 Home Enhancers is deemed acceptance of these Terms and Conditions.
